A separate written service agreement, rate confirmation, work order, or similar contract signed or accepted by you and Fetch Delivery Inc. ("we," "us," "our") controls specific fees, scope, timing, cargo requirements, and duties for each account or shipment. If that agreement conflicts with these terms on a particular point, the service-specific agreement prevails for that service.
2. Services we provide
We offer transportation logistics services, which may include, depending on your agreement:
- Local pickup and delivery of parcels, documents, supplies, and business materials
- Scheduled route delivery and recurring logistics support
- Same-day courier coordination where available
- Small freight coordination, staging, pickup planning, and delivery status updates
- Proof-of-delivery documentation where requested or operationally available
- Customer communication regarding timing, route changes, exceptions, billing, and service matters
We perform services in accordance with applicable New Mexico law, federal transportation rules where applicable, safety requirements, and the terms of your service agreement.
3. Customer responsibilities
Customers agree to:
- Provide accurate pickup, delivery, contact, timing, package, cargo, and billing information
- Package items appropriately and identify fragile, regulated, restricted, high-value, hazardous, or temperature-sensitive materials before service begins
- Ensure shipments are lawful and may be transported under applicable rules and our service policies
- Provide access, recipient instructions, gate codes, dock details, or other operational information needed for delivery
- Notify us promptly of changes in contact information, pickup timing, destination details, or account billing information
4. Fees and billing
- Delivery fees, route fees, courier charges, waiting time, mileage, accessorial fees, and other charges are set out in your service agreement, quote, invoice, or fee schedule
- Unless stated otherwise, fees are earned as described in the applicable agreement or when services are dispatched, performed, attempted, or completed
- Customers remain responsible for costs caused by inaccurate information, unavailable recipients, access delays, rerouting, special handling, or cancellation after dispatch where applicable
5. No guarantee of results
We use professional judgment to plan routes, coordinate pickups, and communicate delivery status, but we do not guarantee delivery times, uninterrupted availability, carrier performance, weather conditions, road conditions, recipient availability, or outcomes of disputes with third parties.
6. Third parties and carriers
We may coordinate with third-party carriers, service providers, warehouses, loading facilities, technology platforms, or other vendors as needed. Their services, warranties, and limitations may apply separately. We are not liable for third-party negligence except to the extent caused by our own failure to exercise reasonable care where required by law or agreement.

- Content is for general information and marketing; it is not legal, tax, or investment advice
- You may not scrape, hack, or misuse the site or attempt unauthorized access to our systems
- We may change or discontinue site features without notice
8. Intellectual property

9. Limitation of liability
To the fullest extent permitted by law, Fetch Delivery Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, business interruption, or loss of goodwill arising from use of the website or services. Our aggregate liability for claims relating to the website, excluding services governed by a separate written service agreement or mandatory transportation law, shall not exceed the greater of (a) the amount you paid us in the three months preceding the claim or (b) one hundred U.S. dollars. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum permitted by law.
10. Indemnity
You agree to indemnify and hold harmless Fetch Delivery Inc. and its personnel from claims arising from inaccurate shipment information, prohibited or improperly packaged items, unlawful instructions, unavailable pickup or delivery access, or misuse of the website or services, except where caused by our gross negligence or willful misconduct as finally determined by a court.

If you opt in to SMS:
- You may receive messages regarding pickups, deliveries, route changes, service alerts, payments, and account updates, and with separate consent, occasional promotions
- Message frequency varies; carrier charges may apply

12. Governing law
These terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules that would apply another state's laws. Venue provisions in your service agreement, if any, apply to disputes under that agreement.
13. Changes
We may update these terms by posting a revised version and updating the “Last updated” date. Continued use of the website after changes constitutes acceptance unless applicable law requires additional notice.
14. Severability
If any provision is held invalid, the remainder remains in effect.
15. Entire agreement (website)
For website use, these terms and the Privacy Policy are the entire agreement. Shipment-specific, route-specific, or account-specific rights and duties are in your applicable service agreement, quote, invoice, work order, or addenda.
